MINUTES

Members Present: Matt Kennedy, Michael Scott, Ken Strom, Dan Hazen, Robert Lowell, and Anthony Costello.

The meeting began at 7:00 PM.

NOTICE OF INTENT - 789 Wachusett Street - Holden Storage - C. Hultgren discussed the revised Stormwater Management calculations as requested by the Conservation Commission. The pre-development rates were still lower than post-development rates. With no further discussion, A. Costello made a motion to close the hearing. M. Scott seconded the motion. All were in favor. A. Costello then made a motion to issue a standard Order of Conditions. M. Scott seconded the motion. All were in favor.

NOTICE OF INTENT - 315 Mason Road - Continued until April 8, 2009.

NOTICE OF INTENT - Winterberry Hollow - M. Donohue commented regarding DEP regulations on stormwater discharge in Zone A. His interpretation that the project is grandfathered is consistent with DEP. Regulations state that the ANRAD or NOI must have been submitted by January 1, 2008. Despite this, D. Getman, representing DCR, believed that the ORAD had expired and that the NOI was initially submitted in July of 2008.

P. McManus made some comments regarding a letter from Graves Engineering dated February 10, 2009. The letter raised several issues such as the possibility that the calculation of recharge is in non-compliance with current DEP standards, and that more details are needed regarding the monitoring of wells, construction phasing, and erosion control.

The floor was then opened to the public for discussion. J. Robinson, an abutter, felt that significant changes have been done since the project was originally submitted. He expressed his concern regarding the dismissal of the new regulations and suggested that the Town Council be consulted for a second opinion.

The Commission will follow up with DEP to confirm it's understanding of the regulations. They also requested that the issues raised in the Graves letter be resolved and that a more detailed plan of construction phasing be submitted. Continued until next meeting.

NOTICE OF INTENT - 502 Wachusett Street - Applicant wants to repair septic system located within 100' of a wetland boundary. M. Farrell, from Green Hill Engineering, informed the Commission that DCR was notified and replied that they were exempt because it was a repair. D. Hazen performed a site walk and found no issues. R. Lowell made a motion to close the hearing. M. Scott seconded the motion. R. Lowell then made a motion to issue a standard Order of Conditions. K. Strom seconded the motion. All were in favor.

ORDER OF CONDITIONS - AMENDMENT - 2451 Main Street - DCR requested changes to bring the redevelopment plan up to new Stormwater Standards. These changes would include paving the parking area, in addition to the additional catch basin stormcepter, infiltrator, and level spreader. The Commission concluded that the paving was not a substantial change from the original Order of Conditions. A. Costello made a motion to amend the Order of Conditions to include the new plans. K. Strom seconded the motion. Vote was 5-0. D. Hazen recused himself.

ORDER OF CONDITIONS - AMENDMENT - Lot A - 34 Sheffield Way - Applicant wants to clear part of his yard area because of storm damage. Feels damaged trees are a hazard. The proposed area is out of the 25' no disturb zone but within the 100' buffer. There is an open Order of Conditions for the construction of the home and the only special condition is that the 25' buffer zone remains undisturbed. After a short discussion, the Commission concluded that it was not a substantial change and can be permitted under the original Order of Conditions. D. Hazen made a motion to amend the Order of Conditions to include the yard clearing. R. Lowell seconded the motion. All were in favor.

ENFORCEMENT ORDER - 96 Malden Street - K. Strom needs to contact the owner and do site walk.

K. Strom made the motion to close the hearing. M. Scott seconded the motion. All were in favor.
